The fee percentage varies between Public Adjusters and is usually capped by local or state law. For example, in the state of Texas, fees cannot exceed 10% of the total claim value.

The first thing they should check is whether the Public Adjuster can legally practice in your state. Public Insurance Adjusters must be licensed in every individual state they practice in. Like other professionals, they also must be bonded and participate in continuing education courses to maintain their licensure. Do not work with any individual, such as a contractor or an attorney, that offers to provide claim adjustment services if they are not licensed to do so. Practicing without a license is not only against the law, but demonstrates that they do not have the appropriate benchmark of knowledge and qualification to help you appropriately.
More than likely, you will be working with the Public Adjuster who does your initial consultation. As a policyholder, you might prefer to work personally with a single Adjuster, but having a firm utilize more than one insurance professional can also sometimes prove beneficial. Due to conflicts of interest, it is against the law for your Public Adjuster to also be your general contractor.
Policyholders who file a claim and receive a proposed settlement from their insurance carrier that they see as unfair often think they need to hire an attorney to dispute their claim. In most cases hiring an attorney is unnecessary and not the most effective course of action. In fact, instead of an attorney, they need to hire a Public Adjuster.
Unfortunately, policyholders commonly hire a Public Adjusters at the end of the process - after an unacceptable claims settlement offer has been made. While a Public Adjuster can assist in reopening a claim and filing a supplemental claim for additional compensation from their insurance carrier, it's always better to engage a Public Adjuster from the beginning in order to avoid such situations.
If a Public Adjuster still believes the policyholder is owed a larger settlement after negotiations with an insurance company are final, then you may consider litigation.
